  BUYER agrees to purchase a total of _____________gallons of Cenex Ultra Low Sulfur Fieldmaster Premium Diesel or Cenex Ultra Low Sulfur Fieldmaster B2 (2% Soy enhanced Premium Biodiesel) at a price of _______ per gallon.  Please circle your preference as they are identically priced.  Road Use taxes, if any, will be added.

  Consumers Co-op agrees to deliver the fuel as needed, up to the stated quantity, with an allowable variance of 10% above or 10% below the quantity stated below.

  THIS CONTRACT REQUIRES A DOWN PAYMENT EQUAL TO TEN CENTS PER GALLON, which will be deducted from the balance due at the end of the contract period or the end of the agreed upon gallons used, whichever comes first.

  Cancellation of this contract or discontinuation of Consumers Co-op as the sole supplier of diesel during the contract period will result in forfeiture of the down payment.  If you use more than 10% over the amount stated above in a contract period, you will be billed at the price in effect at that time.  Also, if you use less than the 10% variation from contracted gallons for a contract period, you will lose the deposit on the gallons that you are short of the 10% variation by.

  This contract obligates Consumers Co-op to deliver the agreed upon gallons at the stated price and also obligates the buyer to accept and pay for those same gallons within the regular statement terms or at seller’s option, this contract will become void.

  This contract is good from March 21, 2008 to November 20, 2008.

  Quoted contract prices are subject to change at any time.  Please call for a current price, 643-3301 or 1-800-446-3301, ext. 11 for Dennis Sprecher, ext. 25 for Dan Baun or ext. 31 for Jason Buchda.  This contract will be executed when payment is received at Consumers Co-op’s Main Office.  A copy of the finalized agreement will be mailed back to you.
